A legal heirship certificate in Pakistan is required when a person dies leaving behind immovable property i.e. house, land, Plot, etc. The deceased’s heirs cannot transfer immovable property in their own name unless they obtain a declaration/ legal heir certificate from the civil court.
Succession Certificate is issued to establish ownership of legal heirs/successors over the deceased persons movable property.
Even though issuance of succession certificate and letter of administration now rests with NADRA (national data base registration authority), under the new legislation , however in case of any controversy regarding rights of legal heirs etc, civil court has jurisdiction to issue legal heirship declaration and succession certificate for immovable and movable property respectively.
